Duties

Work at the provincial level to minimize corruption in the legal system and other governmental institutions. Major sources of corruption are in business licensing (the more permits required, the more bribes must be paid); government procurement; law enforcement (police soliciting bribes to avoid petty arrests); and the judiciary (from "facilitation" payments to court clerks to full scale bribery of judges). Corruption is an intractable issue, requiring Senior RoL Advisors to be creative and resourceful in finding solutions and establishing effective methods of measuring success in this area.


Advise and assist in the development of judicial independence, helping to create a judiciary that is a truly co-equal and independent branch of government. Many current judges have great difficulty adapting to this concept. Senior RoL Advisors must address such issues through mentoring, coaching, and training initiatives.


Work to establish strong, non-politicized, province-wide professional legal associations, with the ultimate objective of linking them as chapters to an Afghan National Bar Association. Particularly important is the establishment of associations (or sections of associations) devoted to developing the skills of young lawyers, young prosecutors, and young judges.


Establish liaison and coordinate with elected and appointed community leaders and other stakeholders in their province to better understand local rule of law needs, capabilities, and capacities, and to build the relationships necessary to effectively promote rule of law initiatives.


Regularly plan and conduct assessments/reviews of existing programs and institutions as a predicate to the development and implementation of new initiatives and projects. This is done in both the criminal and civil arenas and is designed to enhance the capacity of the provincial government, including but not limited to its law enforcement and judicial systems, to deliver justice to the population.

Qualifications and Evaluations
QUALIFICATIONS REQUIRED:
The incumbent must possess:

Juris Doctor Degree or a foreign equivalent, and at least seven years of progressively responsible professional work experience in the legal field. Alternatively, a degree in public administration, court administration, criminal justice, international relations, or other rule of law-related discipline, with at least seven years of progressively responsible professional work experience in that field;

Ability to advise, coach, mentor, and train provincial officials in developing and implementing rule of law initiatives;

Willingness and ability to work collaboratively as part of a multi-disciplinary team in a fast-paced, stressful, high-threat environment;


Preferred skills:

Experience developing and implementing rule of law initiatives in conflict and post-conflict environments; international or domestic legal/justice reform programs; capacity building (or large-scale institution building) programs in international law; or similar experience.

Completion of studies in comparative law, jurisprudence, or Islamic law. Familiarity with Afghan history, culture, institutions, and structures. Farsi, Dari, or Pashtu language capability desirable.

Military or other (Peace Corps, UN, NGO, USAID) experience in planning and coordinating foreign assistance operations. Experience coordinating activities within a USG interagency context.

SECURITY
All candidates for employment must obtain a minimum of a Top Secret
security clearance from the Diplomatic Security Service (DSS). Even
if the candidate has previously held a government security clearance
or still holds one, the candidate must complete a Questionnaire for
National Security Positions (SF-86), a credit/consumer report
release form, and two sets of fingerprint cards for adjudication by
the Diplomatic Security Service. Full disclosure and candor is
imperative when completing this paperwork.

ETHICS
Employees must receive an ethics clearance, which may require
completing and executing the Executive Branch Public Financial
Disclosure Form (SF-278). Ethics clearances are required to help
ensure that employees do not violate, or participate in any actions
creating the appearance that they are violating the law or standards
governing ethical conduct for employees of the Executive Branch.

Employees should read the Department of State's "Ethics Guidance for
Prospective Employees Who Are Not Special Government Employees."

If a SF-278 form is required as part of your application, a
Termination Financial Disclosure Report must be completed upon your
departure from ASO. The Federal ethics and conflict of interest
laws and regulations are important tools intended to foster public
confidence in government.
